These Terms of Use govern your use of FORWINGO platforms and provide information about the FORWINGO Service, outlined below. By creating a FORWINGO account or using FORWINGO platforms, you agree to these terms.
The FORWINGO service is provided to you by FORWINGO UG (limited liability). Therefore, these Terms of Use constitute an agreement between you and FORWINGO UG (limited liability).
The FORWINGO Service
We agree to provide you with the FORWINGO Service. The Service includes all FORWINGO platforms, features, applications, services, technologies, and software.
The Service is comprised of the following aspects:
- Offering personalized opportunities to create, communicate, discover, and share your and others' abilities.
People are diverse, each with a unique mind, ability, and creativity. As a video publisher, we offer our platform to a wide range of smart and talented Competition Creators and Players (Participants) to showcase and monetize their abilities. We aim to strengthen your relationships through shared experiences. Thus, we build systems that try to understand who and what you and others can do, using that information to help you create, join, and share experiences that matter to you. This includes highlighting content, features, offers, and accounts you might be interested in and offering ways for you to experience FORWINGO platforms, based on activities you and others engage in on and off FORWINGO.
- Fostering a positive, inclusive, and safe environment.
We develop and use tools and offer resources to our community members that help make their experiences positive and inclusive, including support when needed. We also have teams and systems that work to combat abuse and violations of our Terms and Policies, as well as harmful and deceptive behavior.
- Ensuring access to our Service.
To operate our global service, we must store and transfer data across our systems around the world, including outside your country of residence. This global infrastructure is necessary to provide our service and may be owned or operated by FORWINGO or its affiliates.
- Research and innovation.
We use the information we have to develop, test, and improve our service, and collaborate with others on research to enhance our service and contribute to the well-being of our community. This includes analyzing user data and understanding how people use our services, for example, by conducting surveys and testing new features.
Your Commitments
In return for our commitment to provide the service, we require you to make the following commitments to us.
Who Can Use FORWINGO?
We strive for our service to be open and inclusive, yet safe, secure, and compliant with the law. Therefore, we need you to adhere to a few restrictions to be part of the FORWINGO community.
General Rules:
FORWINGO is an international platform for talent competition videos, offering a diverse array of contests that adhere to legal standards. Recognizing the unique qualities of each individual, we provide a platform for intelligent and talented competition creators and participants to showcase their skills and earn from their talents.
At FORWINGO, any user can design competitions and invite others to join and take on their challenges. To create a new competition, you must:
- Record a video explaining the nature of your competition and its terms and conditions.
- Set a registration period for users to enter your competition.
- Establish a timeframe for registered participants to complete the competition.
- Specify an entry fee for your competition.
- Determine a prize amount for the winner.
All competitions must comply with the following terms:
- You must not be barred from receiving any aspect of our service under applicable laws or engaging in payment-related services if you are on a denied party listing.
- Your content must not include hate speech, violent or inhumane behavior, criminal or illegal acts, harm to animals, fraud, pornography, sexually explicit material, frontal nudity, money laundering, or any other offensive or objectionable content.
- You must not disclose other users' personal information.
Violations of these terms will result in the removal of the competition and a warning issued to the creator. Accumulating three warnings will lead to account suspension.
For more information, please refer to our Terms of Use, Data Policy, and FAQ. We also clarify that Apple is not a sponsor of any competitions on FORWINGO.
Once a competition is live, all FORWINGO users can view it in the Game List, register within the specified timeframe, and submit their competition videos before the deadline. Videos are displayed in the Participants Tab and ranked by the number of likes received. 48 hours after the competition deadline, the like feature will be deactivated, and the top video with the most likes within 48 hours after the deadline will be considered for the winning entry.
It is crucial for participants to complete the competition promptly and correctly, uploading their video in time to accumulate likes.
Competition creators have the option to extend the deadline up to three times. If a winner is not declared after these extensions, FORWINGO reserves the right to select and announce the winner.
During an extended deadline, all users may register and participate, and previous participants can submit a new and improved video. Users who missed the initial submission deadline can also submit their videos during this extended period.
Editing videos or using cinematic tricks is considered fraud and will result in disqualification. Users found guilty of fraud three times will be permanently banned from FORWINGO.
Therefore, the opinion of other users who see the act, creativity, and ability of any video is very important. Try to be as creative and attractive as possible in your competition to attract viewers' opinions. 48 hours after the deadline, the like tap will be automatically deactivated, and the competition creator is allowed to determine the winner on his/her dashboard that has received the most likes.
How You Can't Use FORWINGO?
Providing a safe and open service for a broad community requires that we all do our part.
You can't impersonate others or provide inaccurate information.
You don't have to disclose your identity on FORWINGO, but you must provide us with accurate and up-to-date information (including registration information), which may include providing personal data. Also, you may not impersonate someone you aren't, and you can't create an account for someone else unless you have their express permission.
You can't engage in anything unlawful, misleading, fraudulent, or for an illegal or unauthorized purpose.
You can't violate (or help or encourage others to violate) these Terms or our Policies, including in particular the FORWINGO Community Guidelines, Platform Terms, and Developer Policies.
If you post branded content, you must comply with our Branded Content Policies, which require you to use our branded content tool.
You can't do anything to interfere with or impair the intended operation of the service.
This includes misusing any reporting, dispute, or appeals channel, such as by making fraudulent or groundless reports or appeals.
You can't attempt to create accounts or access or collect information in unauthorized ways.
This includes creating accounts or collecting information in an automated way without our express permission.
You can’t sell, license, or purchase any account or data obtained from us or our service.
This includes attempts to buy, sell, or transfer any aspect of your account (including your username), solicit, collect, or use login credentials or badges of other users, or request or collect FORWINGO usernames, passwords, or misappropriate access tokens.
You can't post someone else’s private or confidential information without permission or do anything that violates someone else's rights, including intellectual property rights (e.g., copyright infringement, trademark infringement, counterfeit or pirated goods).
You may use someone else's works under exceptions or limitations to copyright and related rights under applicable law. You represent that you own or have obtained all necessary rights to the content you post or share.
You can’t modify, translate, create derivative works of, or reverse engineer our products, platforms, or their components.
You can't use a domain name or URL in your username without our prior written consent.
Permissions You Give to Us
As part of our agreement, you also give us permissions that we need to provide the service.
We do not claim ownership of your content, but you grant us a license to use it.
Nothing is changing about your rights in your content. We do not claim ownership of your content that you post on or through the service, and you are free to share your content with anyone else, wherever you want. However, we need certain legal permissions from you (known as a “license”) to provide the service. When you create, share, or upload games or any content that is covered by intellectual property rights (like photos or videos) on or in connection with our service, you hereby grant to us a non-exclusive, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings) for the purpose of making the FORWINGO service available. This license will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your account. We use the information to control or delete your content.
Use of Your Username, Profile Picture, and Information About Your Relationships and Actions with Accounts, Ads, and Sponsored Content
Your username, profile picture, and information about your actions (such as likes and comments) or relationships (such as follows) can be used next to or in connection with accounts, ads, offers, and other sponsored content that you follow or engage with that are displayed on FORWINGO platforms, without any compensation to you. For example, we may show that you liked a sponsored post created by a brand that has paid us to display its ads on FORWINGO. As with actions on other content and follows of other accounts, actions on sponsored content and follows of sponsored accounts can be seen only by people who have permission to see that content or follow. We will also respect your ad settings.
You agree that we can download and install updates to the service on your device.
How Our Service Is Funded
By using the FORWINGO service for competition creators and players (participants) covered by these Terms, you acknowledge that we can receive 5% from each side (winner prize and participants' payments) and also show you ads that businesses, organizations, and users pay us to promote their brands, productions, services, and their created competitions on and off the FORWINGO platforms.
We show you relevant and useful ads without telling advertisers who you are. We don’t sell your personal data. We allow advertisers to tell us things like their business goal and the kind of audience they want to see their ads. We then show their ad to people who might be interested.
You may see branded content on FORWINGO posted by account holders who promote products or services based on a commercial relationship with the business partner mentioned in their content.
How Much Is the Legal Fee?
The legal fees that will be deducted include the following:
- 19% VAT
- 6% PayPal fee
- 5% FORWINGO fee
The total deduction will be 30% from each side (winner’s prize and participants’ payments).
Content Removal and Disabling or Terminating Your Account
We can remove any content or information you share on the service if we believe that it violates these Terms of Use, our Policies (including our FORWINGO Community Guidelines), or we are required to do so by law. We can refuse to provide or stop providing all or part of the service to you (including terminating or disabling your access to the FORWINGO platforms and FORWINGO Company Products) immediately to protect our community or services, or if you create risk or legal exposure for us, violate these Terms of Use or our Policies (including our FORWINGO Community Guidelines), if you repeatedly infringe other people’s intellectual property rights, or where we are required to do so by law. We can also terminate or change the service, remove or block content or information shared on our service, or stop providing all or part of the service if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts on us. In some cases, when we remove content, we’ll let you know and explain any options you have to request another review, unless you seriously or repeatedly violate these Terms, or if doing so may expose us or others to legal liability, harm our community of users, compromise or interfere with the integrity or operation of any of our services, systems, or products, where we are restricted due to technical limitations, or where we are prohibited from doing so for legal reasons. If you believe your account has been terminated in error, or you want to disable or permanently delete your account, please contact us. When you request to delete content or your account, the deletion process will automatically begin.
If you delete, or we disable your account, these Terms shall terminate as an agreement between you and us, but this section and the section below called "Our Agreement and What Happens if We Disagree" will still apply even after your account is terminated, disabled, or deleted.
If you delete your account for any reason, after deleting it, your account will be deleted, but all the competitions you have created so far, or your information about the competition of others that you have participated in, will remain on the FORWINGO.
Our Agreement and What Happens if We Disagree
If any aspect of this agreement is unenforceable, the rest will remain in effect.
Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be a waiver.
Who Has Rights Under this Agreement?
This agreement does not give rights to any third parties.
You cannot transfer your rights or obligations under this agreement without our consent.
Assignment of Rights and Obligations
Our rights and obligations under these Terms may be assigned to others. For example, this could occur if our ownership changes (as in a merger, acquisition, or sale of assets) or by law.
Updating These Terms
We explicitly state that Apple is not a sponsor of any competitions on FORWINGO.
We may change our service and Policies, and we may need to make changes to these Terms so that they accurately reflect our service and Policies. Changes will be made only if the current provisions are no longer appropriate or are incomplete, and only if the changes are reasonable and considerate of your interests. Unless otherwise required by law, we will notify you before we make changes to these Terms and give you the opportunity to review them before they go into effect. If you continue to use the service after we have posted updated Terms, you are agreeing to be bound by the updated Terms. If you do not agree to these or any updated Terms, you have the option to delete your account.
